BOOKING AGREEMENT AND CANCELLATION POLICY
Upon booking we request a non refundable deposit of the first night’s accommodation and this will secure your reservation.
Should you need to cancel your reservation could you please email our reservations team at reception@thebayhotel.co.uk.
PLEASE NOTE: we will only accept cancellation in writing and this must concur with our cancellation terms. In the event that the booking is cancelled less than 5 weeks before arrival we reserve the right to charge for the entire stay unless we can re-let the room. Although every effort will be made to re-let your room to minimise your loss, we strongly recommended that you arrange holiday insurance to cover the cost of your stay in the face of any unforeseen eventualities. During the peak season times it is at our discretion to only accept two night stays at weekends.
ONLINE BOOKING
As with any technology it is not infallible, but any obvious mistakes will be rectified and a new quote issued to you within 24 hours. N.B No quotes will be guaranteed until a deposit or full payment is made.
RATES
Inevitably prices are subject to change without notice due to fluctuating external circumstances, however, those confirmed upon booking will always be honoured with the exception of a change in the VAT rate whereby the rate will be adjusted accordingly.
Your room rate will be confirmed at the time of booking. Please note we regret that we cannot change the rate or terms of your stay once a booking has been confirmed.
N.B No quotes will be guaranteed until a deposit or full payment is made.
PAYMENT & VAT
For all reservations, payment will be due on check-out by cash or card.
Unfortunately, we do not accept cheques as payment.
VAT is included in all our prices at the current rate.
In the unlikely event that the rate of VAT rises after you have made your reservation, we will notify you of any change in the room rate prior to arrival.
CAR PARKING
There is complimentary parking for residents in our private car park within the hotel grounds.
DOGS
Small and medium sized dogs are welcome at The Bay in some of our rooms, but do please call us for guidance.
There is a £10 per night valeting charge per dog with up to a maximum of 2 dogs in one room.
Food is not supplied but can of course be arranged. Or you may bring your own.
Your dog is welcome with you in the bedroom and the lounge and bar.
Whilst on our property we request that your dog be kept on the lead at all times. There are plentiful walks and the beach is dog friendly.
Your dog is not to be left in the hotel in your absence.
FOOD AND DRINK
With the exception of baby foods, we are sure you understand that we only allow food and drink that has been purchased at the hotel to be consumed on the premises.
ARRIVAL AND DEPARTURE
Your room will be ready from 3.00pm of the day of arrival. However, should you arrive early you are more than welcome to use the hotel’s facilities and we will do our best to get your room ready as soon as possible.
On your day of departure please feel free to use your room until 11.00am.
All guests are required to check out with Reception before departing. Any charges not settled during your stay will be charged to you within 7 days of your departure.
We have no night porter so if you are going to be arriving after 9pm, please ensure that you have contacted us to see if a later arrival is possible as we regret that, otherwise, you will not be able to gain entry.
SMOKING
The hotel is entirely a no-smoking building, including the terrace.
DAMAGE
Customers are politely requested to bring any damage to our hotel or property to our immediate attention, howsoever caused. We need to know in case it might make either other guests or the hotel itself vulnerable to harm and avoids any potential legal action.
It is reasonable that any damage caused by any individual or their animal using the facilities of The Bay Hotel will be charged to that individual in full.
We will contact you after your stay to recover the costs for any repair, replacement or specialist cleaning we incur if you have damaged the hotel or its property.
CHILDREN
All child reservations are on the same terms and conditions as adult reservations.
For suitable rooms for children please ask us.
We regret that we do not as a rule, accept children under 4 years’ old.
We have a few rooms that are suitable for an additional bed, the rate is £45.00 for children under 12 and £65 for those over 12 and under 18 for Dinner, Bed and Breakfast.
LIABILITY
The Bay hotel cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property and its plumbing, gas, electrical or otherwise, or exceptional weather.
The Bay hotel be held responsible for articles of value, other than those deposited with Reception for safe custody for which a receipt will be given and must be retained by the guest.
No responsibility is accepted for loss or damage of property, vehicles or vehicle contents belonging to any member of the party during the occupancy. Subject to the remainder of this clause, you should use your own insurance policies to claim the full amount of the loss or damage to your property prior to approaching or pursuing The Bay Hotel. We are, in certain circumstances set out in the Hotel Proprietors’ Act 1956 (Act), liable for loss or damage to your property. However, in those circumstances, we are only liable up to the maximum sums under the Act.
In all other circumstances, our total liability shall not exceed twice the daily rate charged for your Booking.
The Bay Hotel aims to provide a safe and secure environment for the duration of your stay and where necessary, will take appropriate security measures. If an incident occurs during your stay, resulting in the theft, loss or damage of your property, we will carry out an internal investigation. If we do not feel that your property was stolen, lost or damaged through any fault of ours, our staff or agents, this will be evidence that it was not our fault. In those circumstances, our liability is limited to the maximums under the Act. If an incident is referred to the Police authorities, and they draw the same conclusion as us, this will also be evidence that our liability is limited to those maximums.
We shall not be liable, in any circumstances, for any loss or damage to vehicles you bring to the hotel or any property left in them. Neither shall we be liable for any loss of profit, or any indirect or consequential loss arising under or in connection with your Booking. Where we are liable, we will only be responsible for losses that are a foreseeable result of a breach or negligence, but not otherwise. The loss or damage will be foreseeable if it is an obvious consequence of the breach or is contemplated by both parties at the time of entering into the contract. If due to reasons beyond the control of The Bay hotel, the accommodation is not available whatsoever, The Bay hotel will refund your payment or book you into an equivalent hotel, but will not be under any further liability towards you. Events beyond our reasonable control include, but are not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, interruption or fire (except by way of our default) or failure of (except by way of our default) electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
Statutory Rights: These terms do not affect your statutory rights. If any of these terms conflict with a statutory right or the law changes and your statutory rights change, then the statutory rights will prevail over these terms.
Third Party Rights: A party that is not a party to our Contract shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. The laws of England and Wales govern these terms. The hotel reserves the right to refuse any bookings.
eviivo limited (registered office 154 Pentonville Road, London, N1 9JE company number: 05002392) ("eviivo") operates the Website on which have booked your stay from a purely technical standpoint. You acknowledge that eviivo is not a party to the contract between you and the accommodation establishment that you have selected (‘the Contract’); does not endorse the accommodation service; is not responsible for the quality or safety of the accommodation service; and, is not responsible for the performance of the Contract, including acts or omissions. In no event will eviivo be liable to you for any lost profits or any indirect, consequential, special, incidental or punitive damages arising out of, based on or resulting from your booking even if eviivo has been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence or any other cause or action. Nothing in this clause shall operate to exclude eviivo's liability for death or personal injury resulting from its negligence or any representations made fraudulently.
